L’accesso e l’uso della piattaforma di firma elettronica di Clientify (d’ora in poi, la “Piattaforma”) implica l’accettazione piena delle seguenti norme:

1.- Uso Legale e Responsabile: L’Utente si impegna a utilizzare la Piattaforma esclusivamente per scopi leciti, in conformità con la legislazione applicabile e con queste norme d’uso. È severamente vietato utilizzare la Piattaforma per firmare, inviare o archiviare documenti il cui contenuto sia illegale, illecito, diffamatorio, fraudolento o che, in qualsiasi modo, violi la normativa vigente applicabile.

2.- Responsabilità sul contenuto: L’Utente è l’unico responsabile del contenuto dei documenti che vengono elaborati attraverso la Piattaforma. Clientify non supervisiona né valida il contenuto di detti documenti e, pertanto, non si assume alcuna responsabilità circa la loro legalità, veridicità o validità.

3.- Autorizzazione per l’invio di documenti a terzi: L’Utente dichiara di avere l’autorizzazione espressa, la legittimazione legale o il consenso necessario per inviare documenti da firmare ai destinatari e che questi ultimi sono stati adeguatamente informati e hanno dato il loro consenso a partecipare al processo di firma elettronica.

4.- Divieto di uso fraudolento o abusivo: È vietato utilizzare la Piattaforma per impersonare l’identità di terzi, inviare richieste di firma massiva senza consenso, manipolare documenti elettronici o qualsiasi altro uso che comprometta la sicurezza, la riservatezza o l’integrità del servizio.

5.- Collaboration with authorities: If Clientify detects reasonable indications that the Platform is being used for illicit purposes, it reserves the right to temporarily or permanently suspend the user’s account and may actively collaborate with competent authorities, including providing relevant information to facilitate official investigations, in compliance with data protection regulations and judicial or administrative cooperation.

6.- Suspension and cancellation of service due to improper use: Clientify reserves the right to suspend or cancel the User’s access to the Platform without prior notice in the event of non-compliance with these usage rules or when it detects improper, fraudulent use, or behavior that compromises the proper functioning of the service.

7.- Limitation of Liability: Clientify will not be liable for any direct, indirect, incidental, consequential, or punitive damages related to the use of its electronic signature system, including, but not limited to: loss of profits, business interruptions, data loss, or any other economic loss, even if Clientify has been informed about the possibility of such damages.

8.- Intellectual property: All rights to the Platform, its software, design, trademarks, and content are protected by intellectual property law and belong to Clientify. The User does not acquire any rights over them simply by using the service.

9.- Document Management and Data Protection: Clientify will retain signed documents and associated technical evidence (like IP logs, date and time, identity verification, etc.), as well as personal data collected during the signing process for a minimum period of 5 years from the signing date, in accordance with Regulation (EU) No 910/2014 (eIDAS). This period ensures that signed documents can be used in legal, administrative, or judicial proceedings if necessary.

Once this period has expired, Clientify may delete documents and personal data collected, so it will not guarantee the availability or recoverability of the same.

Participants in the signing process may exercise their rights of access, rectification, deletion, limitation, portability, or objection in accordance with the General Data Protection Regulation (GDPR). To do so, they can contact Clientify’s Data Protection Officer via email at [email protected]

10.- Resolution of Technical Disputes: In case of controversies regarding the authenticity or integrity of the electronic signature generated through Clientify’s signing process:
The parties accept Clientify’s certificate of compliance, issued by “Camerfirma AC”, as prima facie evidence. Any dispute regarding the technical validity of Clientify’s electronic signing process will be resolved by technical assessment in accordance with ISO/IEC 27037:2012, conducted by an accredited entity in Spain.
