Accessing and using Clientify’s electronic signature platform (hereinafter referred to as the “Platform”) means you fully accept the following rules:
1.- Legal and Responsible Use: The User agrees to use the Platform solely for lawful purposes, in accordance with applicable laws and these usage rules. It is strictly prohibited to use the Platform to sign, send, or store documents that contain illegal, unlawful, defamatory, fraudulent content, or that otherwise violate existing regulations in effect.
2.- Responsibility for Content: The User is solely responsible for the content of the documents processed through the Platform. Clientify does not monitor or validate the content of these documents and, therefore, assumes no responsibility for their legality, truthfulness, or validity.
3.- Authorization for Sending Documents to Third Parties: The User declares they have the express authorization, legal legitimacy, or necessary consent to send documents for signature to the recipients, and that those recipients have been properly informed and have given their consent to participate in the electronic signing process.
4.- Prohibition of Fraudulent or Abusive Use: It is prohibited to use the Platform to impersonate third parties, send mass signature requests without consent, manipulate electronic documents, or any other use that compromises the security, confidentiality, or integrity of the service.
5.- Collaboration with authorities: In cases where Clientify detects reasonable indications that the Platform is being used for illegal purposes, it reserves the right to temporarily or permanently suspend the user’s account, and may actively collaborate with the competent authorities, including providing relevant information to facilitate official investigations, in compliance with data protection regulations and judicial or administrative cooperation.
6.- Suspension and cancellation of service for inappropriate use: Clientify reserves the right to suspend or cancel the User’s access to the Platform, without prior notice, in case of non-compliance with these usage rules or when inappropriate, fraudulent use is detected, or when it jeopardizes the proper functioning of the service.
7.- Limitation of Liability: Clientify will not be liable for direct, indirect, incidental, consequential, or punitive damages related to the use of its electronic signature system, including, but not limited to: loss of profits, business interruption, loss of data, or any other economic loss, even if Clientify has been informed of the possibility of such damages.
8.- Intellectual Property: All rights to the Platform, its software, design, trademarks, and content are protected by intellectual property law and belong to Clientify. The User does not acquire any rights over them simply by using the service.
9.- Document preservation and data protection: Clientify will retain signed documents and associated technical evidence (such as IP logs, date and time, identity verification, etc.), as well as personal data collected during the signing process for a minimum period of 5 years from the date of signing. This timeframe ensures that signed documents can be used in legal, administrative, or judicial proceedings if necessary.
Once this period has elapsed, Clientify may delete the documents and personal data collected, and therefore will not guarantee availability or the possibility of recovery of the same.
Participants in the signing process can exercise their rights of access, rectification, erasure, restriction, portability, or opposition in accordance with the General Data Protection Regulation (GDPR). 10.- Resolution of technical disputes: In case of disputes regarding the authenticity or integrity of the electronic signature generated through Clientify’s signing process:
The parties accept Clientify’s conformity certificate, issued by “Camerfirma AC,” as prima facie evidence. Any dispute regarding the technical validity of Clientify’s electronic signing process will be resolved through technical expertise in accordance with the ISO/IEC 27037:2012 standard, conducted by an accredited body in Spain.
