AI Terms of Use

1. Scope of application.

1.1. These AI Tool Terms of Use (hereinafter referred to as the “Terms of Use”) govern the use of the content generation tool powered by artificial intelligence (hereinafter referred to as the “Tool”) integrated into the web-based marketing and sales automation platform called “Clientify” (hereinafter referred to as the “Application”).

These Terms of Use are applicable and form an integral part of the License Agreement for the web-based marketing and sales automation platform called “Clientify” (hereinafter referred to as the “Application”) executed between the following Parties:

• “Clientify, SL”, with its registered address at Padre Luque Street, number 1, 1st-Left; 04001, Almería, Spain, with NIF B-04800249 and contact email [email protected] (hereinafter referred to as “Clientify”), as the owner of the intellectual property and marketing rights of the Application; and
• The Client: Individual or legal entity that has correctly completed and registered the Application’s sign-up form or, as applicable, signed the specific terms of the License Agreement and accepted the General Terms and Conditions of Contracting.

1.2. The use of the Tool entails full acceptance of these Terms of Use, which the Client declares to have read. Furthermore, the Client fully agrees to the General Terms and Conditions of Contracting, the Legal Notice, and Clientify’s Privacy Policy, available at the following links https://clientify.com/wp-content/uploads/2022/08/2021_03_17_-_Conditions_General_of_Contracting_Clientify.pdf, https://clientify.com/legal-notice, and https://clientify.com/privacy-policies, which the Client declares to have read.

2. Scope and Permitted Use.

2.1.The Tool is intended to assist the Client in generating automated content for purposes related to the Application, such as customer management, sales, and marketing.

2.2.The use of the Tool is subject to the following conditions:

– The Client commits to using the Tool solely for legal purposes and within the framework of the business activities permitted by Clientify.

– Any use of the Tool to generate offensive, illegal, defamatory, fraudulent content or content that infringes third-party rights is prohibited.

– Clientify reserves the right to suspend or restrict access to the Tool in case of misuse.

3. Client Responsibility.

3.1. The Client is solely responsible for the content generated using the Tool and its subsequent use.

3.2. Clientify does not guarantee the accuracy, originality, or suitability of the content generated by the Tool.

3.3. The Client must review and validate any generated content before use or publication.

4. Limitation of Liability.

4.1. Clientify shall not be liable for any damages or losses arising from the use of content generated by the Tool.

4.2. Clientify offers the use of the Tool without any express or implied warranties beyond access, allowing the Client to manage content generation through it.

4.3. Clientify shall not assume responsibility for decisions made based on content generated by the Tool.

5. Privacy and Data Protection.

5.1. Clientify will process the data entered into the Tool in accordance with its Privacy Policy and applicable data protection regulations.

5.2. The Client is responsible for not entering sensitive data or data protected by privacy regulations into the Tool without the necessary authorizations.

6. Miscellaneous.

6.1. Clientify reserves the right to modify or rectify these Terms of Use to adapt them to possible legislative changes or market practices. Clientify will publish any changes to the Terms of Use on the Website or through any communication directed to the Client, understanding that consent to the notified modification is given unless the Client expressly opposes it within 30 days and continues to use the Tool.

The refusal to accept the changes to the Terms of Use will terminate the Client’s ability to use the Tool.

6.2. Regardless of what is stated in the contract entered into between Clientify and the Client, Clientify may suspend or interrupt access to the Tool at any time without prior notice, and this shall not entitle the Client to claim any compensation.

7. Applicable Law and Jurisdiction.

The Parties, expressly waiving any other jurisdiction that may correspond to them, submit themselves to Spanish legislation and to the competence and jurisdiction of the Courts of Almería to resolve any matters or disputes that may arise regarding the interpretation, execution, or fulfillment of these Terms of Use.

8. Language.

These Terms of Use are written in Spanish and English. In the case of any discrepancies between the Spanish and English versions, the Spanish version will prevail.
